Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between Toronto Outdoor Lighting ("we," "us," "our," or "Company") and you ("you" or "Customer"). By engaging our services or using our website, you agree to be bound by these Terms.
These Terms apply to all outdoor lighting services provided by Toronto Outdoor Lighting, including landscape lighting, exterior lighting, residential lighting, deck and patio lighting, Christmas lighting, lighting design, and lighting repair and maintenance services. If you do not agree to these Terms, please do not use our services.
Service Descriptions and Scope
Estimates and Quotes
Estimates provided by Toronto Outdoor Lighting are good faith projections based on information available at the time of the estimate. Final pricing may vary based on actual site conditions, material availability, project complexity, and any changes requested by the Customer. A written quote must be accepted in writing before work commences.
Installation and Design Services
Toronto Outdoor Lighting will provide professional installation and design services in accordance with the agreed - upon scope of work detailed in the signed service agreement. We will use industry - standard practices and quality materials. Any changes to the original scope must be documented in writing and may result in additional charges.
Maintenance and Repair Services
Maintenance and repair services will be provided on an as - needed basis. We will diagnose issues, propose solutions, and obtain Customer approval before proceeding with repairs. The cost of parts and labour will be clearly communicated.
Payment Terms
Pricing and Invoicing
Pricing is as agreed upon in the written quote or service agreement. All pricing is in Canadian dollars unless otherwise specified. Invoices are issued upon completion of work or as specified in the service agreement.
Payment Methods
We accept payment via cash, cheque, credit card, debit card, and electronic fund transfer. Payment terms are net upon invoice unless otherwise agreed in writing. A deposit may be required for large projects.
Late Payments
Payments not received within 30 days of invoice date will be considered late. Late payments may result in suspension of services and may incur additional charges or interest as permitted by law.
Additional Charges
Any work performed outside the original scope of work will be charged at our standard rates. Customer will be informed of additional charges and must approve them before work proceeds.
Warranty and Liability
Workmanship Warranty
Toronto Outdoor Lighting warrants that all work will be performed in a professional and workmanlike manner in accordance with industry standards. If you discover defects in our workmanship within 30 days of project completion, we will remedy the issue at no additional charge.
Material Warranty
All materials used are warranted to be free of defects in materials and workmanship per the manufacturer's warranty. We pass through all manufacturer warranties, and defective materials will be replaced at the manufacturer's discretion.
Limitation of Liability
Toronto Outdoor Lighting's total liability for any claim related to services provided shall not exceed the total amount paid by the Customer for the services in question. In no event shall Toronto Outdoor Lighting be liable for incidental, indirect, consequential, or punitive damages, including loss of revenue or profits.
Disclaimer of Other Warranties
EXCEPT AS EXPRESSLY STATED HEREIN, TORONTO OUTDOOR LIGHTING DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Customer Responsibilities
Property Access
The Customer is responsible for providing safe and adequate access to the property where work will be performed. The Customer shall inform us of any hazards, pets, or other conditions that may affect our work.
Utility Location
Prior to any digging or trenching, the Customer is responsible for having underground utilities (gas, water, electrical, telecommunications) located by the appropriate utility companies. Toronto Outdoor Lighting is not responsible for damage to unmarked utilities.
Permits and Approvals
The Customer is responsible for obtaining any required municipal permits or homeowner association approvals prior to work commencing. Toronto Outdoor Lighting will provide information regarding typical requirements but is not responsible for permit acquisition.
Property Damage
The Customer is responsible for any damage to property, landscaping, or structures caused by conditions pre - existing or outside the scope of our work. We will take reasonable precautions to protect surrounding areas.
Cancellation and Postponement
Cancellation by Customer
The Customer may cancel a project with at least 48 hours written notice prior to the scheduled work date. Cancellations made with less than 48 hours notice may result in a cancellation fee equal to 25% of the estimated project cost or the actual labour and material costs incurred, whichever is greater.
Postponement
Projects may be postponed with written notice. If a project is postponed more than two times, a deposit of 25% of the estimated project cost may be required to secure a future work date. Deposits are non - refundable if the Customer cancels the project.
Cancellation by Toronto Outdoor Lighting
Toronto Outdoor Lighting reserves the right to cancel any project if the Customer fails to pay invoices or violates the terms of this agreement. All deposits or payments already made will be retained.
Safety and Regulatory Compliance
Building Codes and Standards
All work performed by Toronto Outdoor Lighting will comply with applicable Ontario building codes, electrical codes, and industry standards. Toronto Outdoor Lighting is a licensed contractor and carries appropriate insurance.
Site Safety
Toronto Outdoor Lighting maintains a safe work environment and follows WSIB safety regulations. The Customer agrees to keep the work area clear of obstacles and hazards and to keep children and pets away during work hours.
Insurance
Toronto Outdoor Lighting maintains comprehensive liability and workers' compensation insurance. The Customer's property insurance should be reviewed to ensure adequate coverage during construction work.
Website Use and Intellectual Property
Website Content
All content on torontooutdoorlighting.ca, including text, images, designs, and logos, is the property of Toronto Outdoor Lighting or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use this content without our written permission.
Permitted Use
You may view, download, and print content from our website for personal, non - commercial use only. You may not use our website for any illegal or unauthorised purpose, or in any way that may infringe upon our rights or the rights of others.
Dispute Resolution and Governing Law
Governing Law
These Terms and all matters relating to our services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Jurisdiction and Venue
You agree to submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any disputes arising from these Terms or your use of our services.
Dispute Resolution
In the event of a dispute, both parties agree to attempt good - faith negotiation before pursuing legal action. If negotiation fails, either party may pursue their remedies through the courts of Ontario.
Changes to These Terms
Toronto Outdoor Lighting reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services following any changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically to stay informed of any updates.
